Cannabis in Thailand: Rules for Tourists in 2023

By January 2023, Thailand had recently eased its ban on recreational cannabis, leading to the emergence of cannabis cafes and weed dispensaries throughout the country. This article summarises the rules for tourists as they stood at that time.

A Confusing "Weed Wild West"

The government's amendments to the laws, and the ongoing debates about the permissible use of cannabis, had created a somewhat confusing situation, often referred to as the "weed Wild West", which could potentially cause issues for tourists. Many people, including cannabis advocate Kitty Chopaka, expressed uncertainty about the accuracy of the information available since legalisation.

To provide clarity, the Ministry of Public Health published a new guide, reassuring tourists that as long as they adhered to a few simple rules, there was nothing to fear. Mendel Menachem, from the cannabis information hub High Thailand, emphasised the importance of following these guidelines.

What Tourists Needed to Know

• Who could consume cannabis? Consumption was legal for individuals over the age of 20 who were not pregnant or breastfeeding.
• Where could you consume it? Smoking cannabis was allowed inside an individual's residence, and consuming cannabis-infused food was permitted at licensed restaurants. Smoking marijuana in public places such as schools, temples and shopping malls could result in a 25,000 baht ($750) fine and a three-month prison sentence. It was important not to encroach on other people's space.
• Where could you buy it? There were over 5,000 weed stores across the country selling various cannabis products, including cannabis flowers, pre-rolled joints, edibles with a THC level below 0.2%, infused foods and CBD oil. It was advisable to buy from reputable, licensed establishments.
• Could you grow it? To cultivate cannabis, individuals had to register with the country's Food and Drug Administration. A permit was required for using cannabis flower buds for research, export or commercial purposes.
• How much could you consume? There was no specific limit for personal consumption; however, the ministry's guide advised against driving after consuming cannabis.

What Remained Prohibited

Tourists were not allowed to enter or leave the country with any part of the cannabis plant or its seeds. Possession of extracts with a THC level higher than 0.2% required permission that tourists were unlikely to have.

Menachem emphasised that people who live in Koh Samui and use cannabis responsibly hope that visitors will respect the country and its people by consuming responsibly.
